Hijaz Kasturi Travel & Tour Sdn. Bhd. General Terms & Conditions: Customers are deemed to have read, understood, and accepted the following terms & conditions listed below:
INTERPRETATION & DEFINITIONS
The Company: Refers to Hijaz Kasturi Travel & Tour Sdn. Bhd. and its authorized Sales Agent/s. Ticket: Refers to air ticket or admission ticket. FIT Package: Refers to “Free Independent Traveler” or “Self Drive” package which includes ground service only. GIT Package: Refers to “Group Independent Traveler” package where the tour will be departed in a group with sufficient group size formed.
THIRD-PARTY USAGE OF HIJAZ KASTURI TRAVEL & TOUR SDN. BHD. NAME
Hijaz Kasturi Travel & Tour Sdn. Bhd. shall not be responsible for any claim by any party or traveler who purchases a tour package from other travel agents using Hijaz Kasturi Travel & Tour Sdn. Bhd.’s name without authorization.
TOUR INFORMATION AND PRICES
Prices shown are current at the time of publication and payment method is in cash (including but not limited to cheque and telegraphic transfers). Tour information and the price list form part of the brochure. The prices are subject to change due to an increase in airfares, other transportation costs, hotel taxes, exchange rates, government tax, etc. Therefore, Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to increase prices and will inform the traveler accordingly before the departure of the tour.
The company covenants the following to be included in tour fare:
- Return air ticket, not including all airport taxes and whatever applicable taxes
- All meals, sightseeing, and other items as specified in the itinerary
- Hotel accommodation, based on:
- Twin sharing basis (2 persons to a room)
- Single supplement (person staying alone – the person concerned must pay the single supplement)
- Triple sharing (3 persons traveling together). For a group of three (3) persons, accommodation is based on double with additional bed or triple sharing basis where applicable. The child tour fare advertised is based on a child who is two (2) years but not more than twelve (12) years of age, sharing a twin room with two (2) adults, whereas infant fare is based on a child who is less than two (2) years from the date of departure.
Items not included in the tour fare are:
- Laundry
- Food and beverage not on the regular menu
- Optional excursions
- Porterage at airport and hotels
- All items of a personal nature
- Medical expenses
- Traveling expenses or any other expenses due to death or illness
- Any expenses incurred by traveler arising from airline’s instruction to off-load the traveler due to any reason whatsoever
- Personal expenses
TOUR FARE
Tour Fare Includes:
- A return air fare on economy class (for GIT package departing by flight) OR a return coach transfer service (for GIT package departing by coach).
- Hotel accommodation or similar class as specified in the itinerary. Subject to the tour fare, accommodation ranges from single room to quad sharing basis, please refer to the tour itinerary for details.
- Meals as specified in the itinerary.
- Sightseeing as stated in the tour itinerary.
- One piece of reasonable size baggage (either travel by flight or by coach). For flights, weight allowance is subject to individual airline’s baggage allowance policy. Infant below 2 years of age is not entitled to free baggage allowance. Surcharge due to overweight, oversized, or extra bags are the responsibility of the customer.
The organizers reserve the right to adjust the cost of package prices due to currency fluctuations or increase in air, rail, road, or ferry transportation, international airport taxes, and fuel surcharges after acceptance of a booking up to and including the date of departure.
Tour fare excludes visa fees, expenses of a purely personal nature such as telephone calls, excess baggage charges, beverages, personal and baggage insurance, food and beverages not on the regular menu, porterage at the airport and hotels, laundry, gratuities to drivers and escorts, optional excursions, and such other charges not expressly included in the brochure. Every package offered contains different inclusions and exclusions. Please refer to the tour itinerary for details.
PAYMENTS
- Payment by credit card is subject to a surcharge.
- Payments made by cheque are only valid upon the clearance of the cheque. All bookings shall only be valid upon the clearance of the booking fees paid to the organizers.
- Payments made by telegraphic and bank transfer are only valid upon the proof of the transfer being forwarded to The Company. All bookings shall only be valid upon the confirmation of clearance by the respective bank.
FIT Tour Packages including airline ticket:
- Upon registration and confirmation of airline ticket request, the traveler must remit full payment for the airline ticket according to the deadline as advised by the person-in-charge at Hijaz Kasturi Travel & Tour Sdn. Bhd.
- For ground and other payments, the traveler must remit a deposit (100% non-refundable) of 35% of the package price (excluding airline ticket) within three (3) days after registration or according to the deadline advised by the person-in-charge at Hijaz Kasturi Travel & Tour Sdn. Bhd. Balance payment must be made forty-five (45) days prior to the departure date or according to the deadline as advised by the person-in-charge at Hijaz Kasturi Travel & Tour Sdn. Bhd.
Ground Tour Packages Only:
- The traveler must remit a deposit (100% non-refundable) of 35% of the package price within three (3) days after confirmation by Hijaz Kasturi Travel & Tour Sdn. Bhd.
- Balance payment must be made forty-five (45) days prior to the departure date or according to the deadline as advised by the person-in-charge at Hijaz Kasturi Travel & Tour Sdn. Bhd.
For Group Series Departure Tour Packages:
- Upon registration, the traveler must remit to Hijaz Kasturi Travel & Tour Sdn. Bhd. the deposit and balance payment in the following manner:
- Payment of deposit during registration
- For Domestic Tour – deposit (100% non-refundable) of 30% of the package price or as advised by Hijaz Kasturi Travel & Tour Sdn. Bhd.
- For Outbound Tour – deposit (100% non-refundable) of 50% of the package price or as advised by Hijaz Kasturi Travel & Tour Sdn. Bhd.
- The balance of payment MUST be made by the traveler no later than thirty (30) days before the date of departure for Group Series Departure tour packages or according to the deadline as advised by the person-in-charge at Hijaz Kasturi Travel & Tour Sdn. Bhd.
- Where the traveler places a booking by filling up the Registration Form
- The traveler must furnish to Hijaz Kasturi Travel & Tour Sdn. Bhd. proof of payment(s) made in order for Hijaz Kasturi Travel & Tour Sdn. Bhd. to proceed with confirmation of bookings.
VISA:
- Where the traveler requests for Visa application only, he or she is required to fill up the relevant visa forms and provide all the required documents to Hijaz Kasturi Travel & Tour Sdn. Bhd.
FAILURE:
- Failure to comply with the requirements above may result in the cancellation of reservation and forfeiture of deposit by Hijaz Kasturi Travel & Tour Sdn. Bhd.

- Payment can be made in cash at the office, or through bank transfer:

AMENDMENT TO BOOKING
For FIT Tour Package:
- Upon confirmation of the tour and where payment has been made, any request by the traveler to make subsequent changes to the reservation is subject to Hijaz Kasturi Travel & Tour Sdn. Bhd.’s approval and an amendment charge of RM 50.00 per person per change. Hijaz Kasturi Travel & Tour Sdn. Bhd. has the absolute discretion to approve or refuse the request.
- In the event Hijaz Kasturi Travel & Tour Sdn. Bhd. declines the request and the traveler cancels the tour, the traveler is subjected to the cancellation charges referred in Clause 1.
- Where Hijaz Kasturi Travel & Tour Sdn. Bhd. approves the traveler’s request, the additional cost due to the changes shall be borne by the traveler.
For Group Series Departure Tour Packages:
- Upon confirmation of the tour no changes can be made to the reservation within forty-five (45) working days before the date of departure subject always to the discretion of Hijaz Kasturi Travel & Tour Sdn. Bhd.
- However, any request from the traveler for any change to come back earlier or later than the group must be made in writing to Hijaz Kasturi Travel & Tour Sdn. Bhd. and will be subject to the conditions of the respective airlines. The traveler acknowledges that he/she may incur additional charges due to this request.
- Changing the entire reservation constitutes a cancellation of the original reservation.
- For change of destination and date of travel requested by the traveler more than forty-five (45) days prior to the date of departure, Hijaz Kasturi Travel & Tour Sdn. Bhd. has the discretion to accept or refuse the request where Hijaz Kasturi Travel & Tour Sdn. Bhd. is dependent on airline’s and supplier’s terms and conditions. Where Hijaz Kasturi Travel & Tour Sdn. Bhd. accepts the request, the traveler must pay an amendment charge of RM 50.00 per person per change in addition to the charges imposed by the airlines or suppliers.
CANCELLATION BY TRAVELER
FIT Tour Packages including Airline Ticket:
- Cancellation by the traveler must be made in writing to avoid any misunderstanding. If the company receives notice to cancel the tour 45 days or more before the date of departure, a minimum administrative fee of RM50.00 or 2% of the tour fare per person will be levied.
- If notice of cancellation is received 30 days or less before the date of departure, the following charges will apply:

- The respective airlines’ cancellation policy applies for FIT tour packages including an airline ticket. Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to charge a service fee of RM50.00 per ticket for each refund application.
Ground Tour Packages Only:
- Cancellation by the traveler must be made in writing to avoid any misunderstanding. If the company receives notice to cancel the tour 45 days or more before the date of departure, a minimum administrative fee of RM50.00 or 2% of the tour fare per person will be levied.
- If notice of cancellation is received 30 days or less before the date of departure, the following charges will apply:

- If notice of cancellation is received 30 days or less before the date of departure, the following charges will apply:

CANCELLATION BY HIJAZ KASTURI TRAVEL & TOUR SDN. BHD.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to cancel the tour due to unavoidable and unforeseen circumstances beyond our control such as the act of god, war, strike, riot, or orders from the Government of Malaysia.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to cancel the tour if the group size does not meet the minimum number of participants required. Should the cancellation be made, Hijaz Kasturi Travel & Tour Sdn. Bhd. shall recommend alternative tours preferably to the same destination or other tours. Should any alternative tour chosen cost more, the traveler shall pay the difference. However, if the alternative tour is cheaper, Hijaz Kasturi Travel & Tour Sdn. Bhd. shall refund the difference to the traveler. Should the traveler decide not to accept the alternative tour, all monies paid shall be refunded in full by Hijaz Kasturi Travel & Tour Sdn. Bhd. to the traveler. The traveler shall not make claims for any damages, additional expenses, or costs suffered.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. will notify the traveler about the cancellation or postponement of the tour not less than fourteen (14) days before the date of departure.
REFUNDS
- No refund or reduction will be made to any traveler who does not complete or commence the journey due to whatsoever reasons or changes after the tour has departed.
- Refunds are only made upon submission of the traveler’s written request together with proof of payment.
RESPONSIBILITY & LIABILITY
- Hijaz Kasturi Travel & Tour Sdn. Bhd. shall not be liable for any injury, damage, loss, or delay affecting the person and/or property of the traveler due to an act of god, war, strike, riot, or orders from the Government of Malaysia, quarantine, epidemic, airport regulations, weather, accident, breakdown, or defect in any vehicle or any other cause beyond the control of Hijaz Kasturi Travel & Tour Sdn. Bhd. or any company or person acting for or on its behalf.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to:
- Alter the sequence or change the date of tour, transportation, accommodation, meals, and sightseeing if there is a need to ensure the smooth and safe operation of the tour.
- Cancel or shorten the duration of any tour in the event of any unforeseen circumstances. The traveler shall not make claims for any damages or costs suffered.
- Require the traveler to leave the tour if the traveler refuses to abide by the rules and regulations imposed by the company or if the traveler is likely to endanger the health and safety of the other traveler on the tour. The traveler shall not make claims for any damages or costs suffered.
COMPLAINTS
- Should a traveler have any complaints during the tour, the traveler shall inform Hijaz Kasturi Travel & Tour Sdn. Bhd.’s representative at the location and must notify Hijaz Kasturi Travel & Tour Sdn. Bhd. in writing within fourteen (14) days from the date of return. Failure to comply with this requirement shall result in Hijaz Kasturi Travel & Tour Sdn. Bhd. being discharged from all liabilities in respect of any claim.
TRAVEL DOCUMENTS & HEALTH PRECAUTIONS
- It is the responsibility of the traveler to ensure that he/she has a valid international passport with a minimum of six (6) months validity from the date of return.
- It is the responsibility of the traveler to ensure that he/she has the necessary visa, vaccinations, health certificates, and all other necessary travel documents as required by the various authorities of the countries to be visited.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. will not be liable for any loss, damage, cost, or expenses incurred due to the traveler’s failure to comply with the above.
TRAVEL INSURANCE
- Hijaz Kasturi Travel & Tour Sdn. Bhd. strongly advises all travelers to purchase travel insurance to protect themselves against personal accident, medical expenses, loss of baggage, delay, and cancellation of the trip, etc.
- Travelers are advised to read and understand the terms and conditions of the insurance policy prior to the purchase of the policy.
RIGHTS OF HIJAZ KASTURI TRAVEL & TOUR SDN. BHD.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to amend the terms and conditions as and when necessary without prior notice.
- Hijaz Kasturi Travel & Tour Sdn. Bhd. reserves the right to take the necessary actions against any party who uses Hijaz Kasturi Travel & Tour Sdn. Bhd.’s name without prior authorization.
Please read these Terms and Conditions carefully before using the services offered by Hijaz Kasturi Travel & Tour Sdn Bhd (“Hijaz Kasturi™” or “We”, “Us”, or “Our”), a company incorporated under the laws of Malaysia. These terms set forth the legally binding terms and conditions for your use of Our Services as contained in https://HijazKasturi.my/rental-landing-page (“Website”) (collectively with the site, referred to as “Services”).
DRIVER’S AGE AND LICENCE REQUIREMENTS
The Renter and additional drivers must be between 23 to 65 years old for normal car category vehicles and 25 to 65 years old for luxury car category vehicles and in possession of a full and valid national or International Driving Licence. Other nationals who hold a valid driving license in English can drive in Malaysia for a maximum of 3 months (subject to country). Probational license holders will not be accepted.
RENTAL PERIOD
The Renter shall rent the vehicle for the rental period stated in the booking confirmation. Hijaz Kasturi Travel & Tour Sdn Bhd may agree to extend this rental period at its own discretion. If the renter fails to return the vehicle at the end of the period, Hijaz Kasturi Travel & Tour Sdn Bhd shall either charge the rental at the contracted rate for the period of time renter has possession of the vehicle or Hijaz Kasturi Travel & Tour Sdn Bhd resumes possession of the vehicle, in which case the renter shall be liable for all costs and expenses incurred by Hijaz Kasturi Travel & Tour Sdn Bhd in resuming possession of the vehicle. The Renter shall return the vehicle, together with all tyres, tools, accessories, and equipment to the Hijaz Kasturi Travel & Tour Sdn Bhd station specified or any location on the enclosed rental agreements (location & date).
2.1 Hijaz Kasturi Travel & Tour Sdn Bhd Responsibilities
- Hijaz Kasturi Travel & Tour Sdn Bhd shall maintain the vehicle to the manufacturer’s recommended standard.
- Hijaz Kasturi Travel & Tour Sdn Bhd undertakes to ensure that the vehicle is in a roadworthy condition and suitable at the beginning of the rental period.
- To ensure the car comes with valid insurance coverage.
- Provide a replacement vehicle in case of accident or breakdown with a similar class that was rented from Hijaz Kasturi Travel & Tour Sdn Bhd.
2.2 Renter’s Responsibilities
- The Renter shall ensure the vehicle and keys are kept in good condition at all times during the period of the rental.
- The Renter shall ensure the vehicle is kept locked when not in use, and the Renter will incur a charge (which Hijaz Kasturi Travel & Tour Sdn Bhd will set from time to time) for lost keys.
- The Renter shall utilize any security device fitted to or supplied with the vehicle. The Renter must ensure that the correct fuel is used for the vehicle.
- The Renter shall be fully responsible for any damage to the exterior part of the vehicle (front, rear, upper, lower sides, and undercarriage) caused by hitting any object. This applies irrespective of whether or not the Renter has opted for the super liability reduction option and liability reduction option in accordance with clause.
- The Renter shall not sell, rent, remove, replace, or dispose of the vehicle or any of its parts. The Renter shall not grant any person(s) any legal right over the vehicle.
- The Renter shall not carry out any repair or service work on the vehicle without obtaining the written permission of Hijaz Kasturi Travel & Tour Sdn Bhd.
- The Renter must notify Hijaz Kasturi Travel & Tour Sdn Bhd immediately upon becoming aware of a defect or damage in the vehicle, and the Renter is liable for all damage and loss (including theft) caused to the vehicle during the rental period.
- Upon the end of the rental period, the Renter shall return the vehicle to the agreed return location, during the operating hours displayed at the rental location. If Hijaz Kasturi Travel & Tour Sdn Bhd has agreed that the Renter may return the vehicle outside operating hours, or if the Renter has requested collection of the vehicle, the Renter’s liability for damage, theft, parking violations, and charges shall extend to midday on the first working day following the collection time (working day is defined according to station operating hours or the time of re-inspection of the vehicle by a member of Hijaz Kasturi Travel & Tour Sdn Bhd’s team).
- Damage to the vehicle includes damage and/or loss of glass, tyre rims, vehicle lights, tyres, and interior accessories.
- The Renter shall pay for repairs if the vehicle requires more than Hijaz Kasturi Travel & Tour Sdn Bhd’s standard cleaning, or if the vehicle has been damaged on the interior or exterior (whether or not it is the Renter’s fault).
- The Renter shall ensure, upon the return of the vehicle, that no personal belongings are left in the vehicle, and Hijaz Kasturi Travel & Tour Sdn Bhd shall not be responsible for any of the Renter’s personal belongings left in the vehicle.
- The Renter should prepare the necessary card, especially Touch N Go card, by their own. Hijaz Kasturi Travel & Tour Sdn Bhd will not be responsible for or entertain any issue of claim/refund regarding the card.
RATES
Rates are for a minimum of 24 hours of rental. Additional hours will be calculated upon booking at one-fifth of the daily rate per hour, up to a maximum of 5 hours upon booking. Rates include unlimited mileage, maintenance, passenger liability protection, and insurance cover of third-party property damage and third-party bodily injuries. Hijaz Kasturi Travel & Tour Sdn Bhd does not practice any prorate. Therefore, there is no refund due to early return. Rates are in Ringgit Malaysia and are subject to change without prior notice.
TERM OF PAYMENT
4.1 Mode of Payment
Hijaz Kasturi Travel & Tour Sdn Bhd accepts credit and debit cards Visa and MasterCard upon online booking. Third-party credit cards are not accepted. The credit card presented must be in the name of the authorized renter. Hijaz Kasturi Travel & Tour Sdn Bhd reserves the right to refuse its car rental services if this term is not met. Cash transactions are not acceptable.
4.2 Deposit
In addition to the rental charges, the customer is responsible for paying a deposit. We reserve the right to terminate the rental agreement if the customer fails to make payment at the time specified. The deposit serves as a guarantee for the proper usage of the vehicle for the entire duration of the contract and will be reimbursed if no damage is reported. The deposit should be paid upon booking confirmation and will be refunded to the user’s account after 15 days of the car’s return. The Renter must request the withdrawal themselves.
TRANSPORT CANCELLATION AND REFUND POLICY
5.1 Full Refund
Reservations canceled by email or call to our hotline within one (1) week / seven (7) days before the start of the rental. Cancellation of reservation/booking must be made in writing to avoid any misunderstanding.
5.2 Partial Refund
Cancellations made within 3 days / 72 hours before the start of the rental will be charged 50% of the rental fee. Downgrade of the vehicle within 3 days / 72 hours before the start of the rental will be charged 50% of the rental fee of the original booking.
5.3 No Refund
Cancellations made less than 24 hours before the start of the rental. Cancellations made to downgrade the vehicle less than 24 hours before the start of the rental. Failure to provide the actual driver as registered on the form to collect the car at the specified date & time. Vehicle cannot be picked up or failure to collect the car at the specified date & time.
5.4 Claim & Refund Process
Contact us within the time stated in the cancellation policy to document the issue and place a hold on the booking payment. Include invoice or other evidence of the issue as part of your claim.
- Be responsive to our requests for additional information and cooperation.
- Have used reasonable efforts to remedy the circumstances of the Rental Issue with the driver/person-in-charge prior to making a claim, including messaging your contact at Hijaz Kasturi Travel & Tour Sdn Bhd to notify them of the issue.
- We’ll notify the transaction of the refund through email. The amount will be credited to the customer’s account after the car is returned. The Renter can request a withdrawal by themselves, 15 days after the car’s return.
EXTENSION OF RENTAL AND PENALTY
Should the Renter wish to extend the rental, appoint any additional drivers, or amend the pick-up or return location, it is compulsory to advise Hijaz Kasturi Travel & Tour Sdn Bhd immediately to facilitate the extension of insurance coverage. Failure to notify and payment will incur a penalty. Charges and types of penalties will apply.
OTHER CHARGES
The Renter shall pay the following charges:
- The rental charges and other optional charges at the rates shown on the rental agreement.
- Any charges for loss or damage resulting from non-compliance.
- A refueling charge for insufficient fuel tank upon return (check-in).
- On demand, all fines and court costs for parking, traffic, or other offenses (including any costs arising if the vehicle is clamped or towed). The Renter must pay the appropriate authority any fines and costs, failing which, the Renter shall be responsible to pay Hijaz Kasturi Travel & Tour Sdn Bhd an administration fee of Ringgit Malaysia Two Hundred (MYR200.00) when Hijaz Kasturi Travel & Tour Sdn Bhd deals with these matters.
- On demand, the full cost of repairing or replacing the vehicle if it is damaged or stolen (even if it is not the Renter’s fault). The Renter may not have to pay the whole cost of repairing or replacing the vehicle if the Renter has accepted Hijaz Kasturi Travel & Tour Sdn Bhd’s Liability Reduction Option.
- On demand, a loss of income charge. Hijaz Kasturi Travel & Tour Sdn Bhd will charge the Renter at the contracted rate if Hijaz Kasturi Travel & Tour Sdn Bhd is unable to rent out the vehicle due to repair or total loss, and Hijaz Kasturi Travel & Tour Sdn Bhd is waiting to receive full payment of the vehicle’s value. Hijaz Kasturi Travel & Tour Sdn Bhd shall not charge the Renter for more than 30 days of loss of income. The Renter shall also be liable for any diminution in the vehicle’s value on resale as a result of damage during the rental period.
- Any charges made by the authorities as a result of a seizure.
- Any rates for delivering and collecting the vehicle which Hijaz Kasturi Travel & Tour Sdn Bhd will set from time to time.
- On demand, Hijaz Kasturi Travel & Tour Sdn Bhd’s costs including legal fees where permitted by law, incurred in collecting payments due from the Renter hereunder.
- Value-added tax and all other taxes and levies on any of the charges listed above, as appropriate.
RISK AND PROTECTION
The Renter shall be held responsible for all MAJOR DAMAGES caused to the vehicle, including theft regardless of fault. In the event of an accident or theft, PROVIDED the Renter has agreed to accept the LRO and make a police report within 24 hours from the time of the accident or theft, Hijaz Kasturi Travel & Tour Sdn Bhd shall be entitled to charge the Renter an excess fee in accordance with the following table (“Excess Fee”). Upon the Renter’s acceptance and subject to the terms and conditions stipulated in the Rental Agreement, the Renter’s liability is limited to the Excess Fee.

8.2 ZURICH Travel Insurance
The Renter may also purchase Zurich Travel Insurance (Z -Travel Domestic/Inbound Policy), provided by Zurich General Insurance Company Berhad.
The insurance shall apply to any insured person from age 30 days up to 80 years old, except if the insured person is aged 70 years and above upon the commencement of the insured journey, they will only be entitled to 50% of BENEFIT A – Accidental Death and Permanent Disablement.
CONDITION OF USAGE VEHICLE
- The vehicle shall not be operated by any person(s) who has given Hijaz Kasturi Travel & Tour Sdn Bhd a fictitious name, false age, or address.
- The vehicle shall only be driven by person(s) named overleaf or by anyone Hijaz Kasturi Travel & Tour Sdn Bhd authorizes in writing. Anyone driving the vehicle must have held a valid full current driving license for at least one year.
- Probationary license holders are strictly not permitted to drive Hijaz Kasturi Travel & Tour Sdn Bhd’s vehicle.
- The Renter or any authorized driver shall not use the vehicle for hire or reward, any illegal purpose, off-road, racing, pacemaking, test driving, testing the vehicle’s reliability and speed, to propel or tow any vehicle or trailer, or to teach someone to drive, under the influence of alcohol, drugs, or any other illegal substances as determined by the authorities.
- The vehicle must not carry a number of passengers and/or baggage which could cause the vehicle to be overloaded or transport goods in violation of customs regulations or in any illegal manner as determined by the authorities.
- Entry to Thailand is strictly prohibited.
- The vehicle must not be used in any manner that causes an unpleasant odor (e.g., durian, salted fish, perfume, materials used in religious practices, etc.).
CROSS BORDER TO SINGAPORE
The Renter has the flexibility to drive to Singapore with the following requirements:
- Declare destination upon booking.
- Purchase additional insurance upon booking.
Hijaz Kasturi Travel & Tour Sdn Bhd will not entertain any refund request for Autopass card balance.
RESTRICTED ENTRY
Hijaz Kasturi Travel & Tour Sdn Bhd vehicles cannot be driven into Thailand, Brunei, and Indonesia. Vehicles are also prohibited from being loaded onto other modes of transportation via sea, river, and air for usage from the mainland to Langkawi, Tioman, Redang, Pangkor Island, etc. Cross-border to Singapore is subject to approval with certain conditions and additional insurance.
RENT-IT-HERE, LEAVE-IT-THERE
A minimum rental of 2 days will apply, and a repositioning fee will be levied based on kilometers for one-way rentals. Details on the charges and procedures will be made available at the time of the online inquiry. This service is only applicable between Hijaz Kasturi Travel & Tour Sdn Bhd locations and coverages.
TERMINATION OF AGREEMENT
The rental agreement will be terminated upon the occurrence of one of the following events:
- Failure to make punctual payment of rental or any amount due hereunder.
- Failure to observe or perform any condition, term, or covenant herein.
- If the Renter suffers any distress or execution to be levied on the Renter’s goods, or if the Renter, being a company, makes arrangements with creditors, enters into liquidation (whether compulsory or voluntary), has a receiver appointed, or a winding-up order or proceedings are levied or threatened upon the Renter, or if any judgment against the Renter remains unsatisfied for more than thirty (30) days.
GOVERNING LAW
This agreement is governed by the laws of Malaysia. Any dispute may be submitted to the jurisdiction of the Malaysian Courts. If any provision of this Agreement is or becomes invalid or unenforceable, the remaining provisions shall not be affected.
